Bye Bye Button - Disclaimer and Waiver

This Disclaimer and Waiver ("Agreement") is a legally binding document between the user ("You") and Ejection Seat LLC ("Company," "We," "Us," or "Our"). By using the Bye Bye Button application ("App") and associated hardware device ("Device"), You acknowledge and agree to the terms set forth in this Agreement.

1. General Disclaimer

The Bye Bye Button is intended for personal and entertainment use only. The Company makes no representations or warranties, express or implied, regarding the reliability, effectiveness, or accuracy of the App or Device.
The Company does not guarantee that the Bye Bye Button will work under all circumstances, including but not limited to Bluetooth Low Energy (BLE) connectivity issues, cloud server outages, or third-party service interruptions, nor that it will provide uninterrupted or error-free operation. The App and Device are not a substitute for emergency services and should not be relied upon in situations requiring emergency communication or where personal safety is a concern.

2. Assumption of Risk

By using the Bye Bye Button, You assume all risks associated with its use, including but not limited to:

  • Any unintended consequences arising from reliance on the App or Device, such as harassment, fraud, or illegal activities resulting from misuse;
  • Potential malfunctions, disruptions, or unintended phone activity, including those caused by BLE connectivity failures or cloud server delays;
  • Any legal or regulatory issues associated with using a fake call or message function in certain jurisdictions.
    You acknowledge that the Company is not responsible for any actions You take based on reliance on the Bye Bye Button.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR MISUSE OF THE APP OR DEVICE, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, business, or reputation;
  • Damage to personal devices;
  • Any legal consequences resulting from improper use of the App or Device;
  • Service interruptions due to BLE connectivity issues, cloud server failures, or third-party service disruptions.
    Your sole remedy for dissatisfaction with the App or Device is to stop using it.

4. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your misuse of the App or Device;
  • Any violation of applicable laws or regulations;
  • Any breach of this Agreement.

5. No Warranties

THE APP AND DEVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
The Company makes no warranty that the App or Device will meet Your requirements, be error-free, or function as intended in every environment, including during BLE connectivity issues or cloud server downtimes.

6. Legal Compliance and Use Restrictions

You acknowledge that laws regarding fake phone calls, messages, and automated notifications vary by jurisdiction. It is Your responsibility to comply with local laws regarding the use of the Bye Bye Button.
The Company is not responsible for any legal consequences arising from the use of the App or Device in a manner that violates applicable laws or regulations.

7. Release of Claims

To the fullest extent permitted by law, You release and waive any and all claims, demands, and damages (actual or consequential) of every kind and nature against the Company, its affiliates, officers, employees, and agents, arising out of or in connection with the use of the App and Device.
If You are a California resident, You waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her, must have materially affected his or her settlement with the debtor."

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Montana, excluding its conflict of law principles.
Any dispute arising from or relating to this Agreement shall be resolved through binding arbitration in Bozeman, Montana, administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to a jury trial or class action.

9. Modifications to This Agreement

We reserve the right to modify this Agreement at any time. Continued use of the App or Device after any changes constitute Your acceptance of the revised terms.
