This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Ejection Seat LLC ("Company," "We," "Us," or "Our"), governing your use of the Bye Bye Button mobile application ("App") and associated hardware device ("Device"). By downloading, installing, or using the App and/or Device, You agree to be bound by this Agreement.

1. License Grant

The Company grants You a limited, non-exclusive, non-transferable, and revocable license to use the App and Device solely for personal, non-commercial use in accordance with this Agreement.
The App may include a free version with limited features (e.g., on-device reminders) and premium features (e.g., fake calls or messages) that require payment, as detailed in Section 4.

2. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App or Device;
  • Use the App or Device for illegal, fraudulent, or deceptive purposes;
  • Reproduce, distribute, or resell the App or Device without prior written consent from the Company;
  • Attempt to gain unauthorized access to any part of the App, Device, or related services.

3. User Responsibilities

You are responsible for ensuring that your use of the App and Device complies with all applicable laws, including telecommunications regulations (e.g., the U.S. Telephone Consumer Protection Act) related to fake calls or messages.
You must not use the App or Device in any way that could cause harm, distress, or deception to others.
The App and Device are for entertainment purposes only and are not a substitute for emergency communication services.

4. Fees and Payments

The App is free to download, and a basic version with limited features (e.g., on-device reminders triggered by the Device) is available at no cost. Premium features, such as generating fake calls or messages via our cloud server, may require a small fee per use or a subscription, as outlined on our website or in the App.
Payments are processed through third-party payment providers, and You agree to abide by their terms.
The Company reserves the right to modify pricing or introduce new paid features with notice via the App or email.

5. Privacy and Data Collection

We collect and process certain data as described in Our Privacy Policy, including but not limited to phone numbers, device usage, and payment information.
By using the App, You consent to such data collection and processing.

6. Intellectual Property

The App, Device, and all related intellectual property are owned by the Company and protected under applicable copyright and trademark laws.
This Agreement does not grant You any ownership rights in the App or Device.

7. Disclaimer of Warranties

The App and Device are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
The Company does not guarantee uninterrupted, error-free, or secure operation of the App or Device, including during Bluetooth Low Energy (BLE) connectivity issues, cloud server outages, or third-party service interruptions (e.g., VOIP or SMS providers).

8. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the App or Device, including but not limited to damages caused by:

  • Technical failures of BLE connectivity, cloud servers, or third-party services;
  • Legal consequences from misuse or non-compliance with applicable laws;
  • Loss of data or damage to devices.
    Your sole remedy for dissatisfaction with the App or Device is to stop using it.

9. Termination

The Company may terminate this Agreement at any time if You violate any terms herein.
Upon termination, You must cease all use of the App and Device.

10. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Montana, excluding its conflict of law principles.
Any disputes shall be resolved through binding arbitration in Bozeman, Montana, administered by the American Arbitration Association under its Commercial Arbitration Rules, except where prohibited by law.

11. Changes to this Agreement

The Company reserves the right to modify this Agreement at any time.
Continued use of the App and Device after changes constitutes acceptance of the revised Agreement.
